Religion and Constitutionalism: Oscillations Along a Continuum

This review article analyses three books published between 2010 and 2013 and explores the ways in which a nation, secular or otherwise, can deal with religion within its borders, both legally and socially. For many nations, this means employing a foundational document or text, usually a constitution, to exclude religion from, neutrally to structure its participation in, or actively to promote a particular type of it in the public arena. The article develops two primary themes. First, using Ran Hirschl's work, it reveals a continuum of approaches to the constitutional treatment of religion; yet, in plotting those points along the continuum, what one finds is far from precision placement; rather, there is oscillation around several points. Second, in considering specific constitutions, it becomes apparent that the more difficult or ambiguous it is to modify or amend a formal text, the greater the importance assumed by judicially developed interpretative techniques.

La théorie et l’histoire de la sociologie, la sociologie de la culture et l’anthropologie sont ses principaux axes de recherche.

Frithjof Nungesser ist Universitätsassistent am Institut für Soziologie der Karl-Franzens-Universität Graz; zugleich ist er Gastkollegiat am Max-Weber-Kolleg für kultur- und sozialwissenschaftliche Studien der Universität Erfurt. Seine Arbeitsschwerpunkte sind: Soziologische Theorie, Soziologiegeschichte, Kultursoziologie, Anthropologie.

Jean Bazin – notice

Der französische Anthropologe Jean Bazin (1941–2001) war directeur d’études an der École des hautes études en sciences sociales (EHESS). Er leitete dort zunächst das Centre d’anthropologie des mondes contemporains, bevor er sich dessen Umstrukturierung zur gemeinsamen Forschungseinheit (CNRS-EHESS) »Genese und Wandel sozialer Welten« (GTMS) verschrieb. Gegen Ende seines Lebens widmete sich der Afrika-Spezialist mehr und mehr einer kritischen Reflexion über die Gegenstände der Anthropologie.

L’anthropologue Jean Bazin (1941-2001) était directeur d’études à l’EHESS. Il y a dirigé le Centre d’anthropologie des mondes contemporains avant de se dévouer à sa transformation en unité associée (CNRS-EHESS) : « Genèse et transformations des mondes sociaux ». Africaniste, il se tourne de plus en plus vers une réflexion critique sur les objets et les méthodes de l’anthropologie.

Der französische Religionssoziologe Camille Tarot (Jahrgang 1943) war bis 2011 Professor an der Universität Caen. In seinen Arbeiten widmete er sich vor allem der Problematik des Symbolischen und des Heiligen. Er ist permanentes Mitglied des Centre d’étude et de recherche sur les risques et les vulnérabilités (CERReV – Forschungszentrum über Risiken und Vulnerabilitäten).

Camille Tarot, né en 1943, est un sociologue français. Spécialiste de sociologie des religions, il s’est surtout consacré aux questions du symbolique et du sacré. Jusqu’en 2011, il a été professeur à l’université de Caen. Il est membre permanent du Centre d’étude et de recherche sur les risques et les vulnérabilités (CERReV).

Éric Brian – notice

Der französische Wissenschaftshistoriker und Soziologe Éric Brian ist directeur d’études an der École des hautes études en sciences sociales (EHESS). Er erforscht die Ungewissheit bzw. Regelmäßigkeit sozialer Phänomene, insbesondere die Art und Weise, wie Wissenschaftler sie aus der Sicht der Mathematik und der Wirtschafts- und Sozialwissenschaften erfasst haben. Seit 1995 ist er Herausgeber der Revue de synthèse. Seine Forschungsschwerpunkte sind : Geschichte der Mathematik, Wirtschafts- und Sozialwissenschaften, Epistemologie der Sozialwissenschaften und allgemeine Soziologie.

Éric Brian, directeur d’études à l’EHESS (Paris), est historien des sciences et sociologue. Il étudie l’incertitude et la régularité des phénomènes sociaux et notamment la manière dont les savants les ont saisies et conçues du point de vue des mathématiques et des sciences économiques et sociales.
