Directeur de recherches au CNRS, sociologue, juriste et politiste, Pierre Lascoumes est l’un des principaux artisans des progrès et des renouvellements de la sociologie du droit en France. Plaidant, dans une perspective wébérienne, pour une approche « interactive » du droit, ses travaux proposent de tenir compte de toute l’épaisseur du jeu social dans la négociation et la construction des normes juridiques. Cette sociologie prend le droit et ses techniques au sérieux, en observant de près, dans différents espaces sociaux, les dimensions collectives des politiques publiques et de leurs mises en œuvre. En reliant fondamentalement action et connaissance, pratiques sociales et savoirs, Lascoumes montre comment « penser avec le droit » est aussi un moyen d’agir politiquement pour « changer la société » (Lascoumes, 2009a).

Conservative Ideological Resurgence, Nationalist Rallying, and Students: The German Burschenschaft and Antisemitism, 1890–1900

Where the Burschenschaft fraternity led, so followed the German middle classes, for the first century of this influential student society’s existence at any rate.11 Its members (Burschenschafter) mobilized German nationalists across central Europe in the early nineteenth century. They helped spread liberal ideas, and indeed by the end of the Napoleonic Wars, around one-third of German-speaking students outside Austria were members of the Burschenschaft. Students united in Burschenschaft fraternities continued to fight for equality for all virtuous men and for reform of political institutions in the post-Napoleonic period. They risked their lives in their battle for a united Germany and liberal change in the revolution of 1848. The Imperial period (1871-1918) saw the founding of such diverse university organizations as Catholic, Protestant, and Jewish associations, Turner (gymnastics) associations, free duelling student fraternities, and the Free Students (Freie Studentenschaft), and this reduced the proportion of Burschenschafter to only five to eight per cent of all students. Nevertheless, the Burschenschaft still constituted the most elite group for scholars, writers, and independent professionals such as doctors and lawyers.22
